Bay Area Panels operates as a connection service. We facilitate introductions between homeowners seeking electrical services (such as panel upgrades, home rewiring, and EV charger installations) and licensed, qualified electrical contractors in the Bay Area. We do not directly perform electrical work. All contracts for electrical services are directly between you, the homeowner, and the independent electrical contractor.
Our Service is provided on an "AS IS" and "AS AVAILABLE" basis. Bay Area Panels makes no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content, materials, or products included thereon. You expressly agree that your use of the Service is at your sole risk.
While we strive to connect you with reputable contractors, we do not warrant that the electrical services provided by third-party contractors will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We are not responsible for the quality, safety, or legality of the services performed by third-party contractors.
In no event shall Bay Area Panels, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
You agree to defend, indemnify, and hold harmless Bay Area Panels and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; or b) a breach of these Terms.
These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
